Estos términos rigen el uso de este sitio y de las plataformas de software que J&J Consulting Engineering Group LLC opera para sus clientes.

These terms govern use of this website and of the software platforms J&J Consulting Engineering Group LLC operates for its clients.

1. Quiénes somos

Construimos y operamos asistentes de IA y plataformas de software — entre ellas, plataformas de agenda que gestionan las citas de un negocio y avisan a sus clientes. El alcance concreto, el precio y la duración de cada servicio se pactan por separado con cada negocio; estos términos son el marco común.

We build and operate AI assistants and software platforms — among them scheduling platforms that manage a business's appointments and notify its customers. The scope, price and duration of each service are agreed separately with each business; these terms are the common framework.

3. Mensajes a los clientes de un negocio

3. Messages to a business's customers

Cuando la plataforma envía un mensaje de texto al cliente de un negocio, lo envía en nombre de ese negocio. El negocio es responsable de haber obtenido el consentimiento de esa persona y de que sus datos de contacto sean correctos. J&J Engineering provee el medio técnico y registra la prueba del consentimiento; no sustituye al negocio en esa obligación.

When the platform sends a text message to a business's customer, it sends it on that business's behalf. The business is responsible for having obtained that person's consent and for the accuracy of her contact details. J&J Engineering provides the technical means and records the evidence of consent; it does not take that obligation over from the business.

Un negocio que usa la plataforma se compromete a:

A business using the platform agrees to:

  • obtener el consentimiento antes de que se envíe cualquier mensaje, y no cargar números obtenidos de otra forma;
  • obtain consent before any message is sent, and not to load numbers obtained any other way;
  • no incluir contenido publicitario — ofertas, descuentos, promociones o enlaces — en unos mensajes que son transaccionales. La plataforma lo impide técnicamente, y el intento de sortearlo es un incumplimiento;
  • include no marketing content — offers, discounts, promotions or links — in messages that are transactional. The platform prevents it technically, and attempting to work around it is a breach;
  • respetar de inmediato cualquier baja, cualquiera que sea la forma en que el cliente la exprese;
  • honour any opt-out immediately, however the customer expresses it;
  • cumplir las leyes aplicables, incluida la TCPA de EE. UU. y las reglas de los operadores.
  • comply with applicable law, including the US TCPA and carrier rules.

Podemos suspender el envío de mensajes de un negocio, sin aviso previo, si tenemos motivos razonables para pensar que se incumple lo anterior. La razón es sencilla: el número de envío es compartido, y la conducta de un negocio afecta a todos los demás.

We may suspend a business's messaging, without prior notice, where we reasonably believe the above is being breached. The reason is simple: the sending number is shared, and one business's conduct affects every other.

4. Uso aceptable

4. Acceptable use

No se puede usar el servicio para actividades ilegales, para enviar comunicaciones no solicitadas, para intentar acceder a datos de otro negocio, ni para poner en riesgo la disponibilidad del sistema. Las credenciales son personales y quien las tiene responde por lo que se haga con ellas.

The service may not be used for unlawful activity, to send unsolicited communications, to attempt access to another business's data, or to endanger the availability of the system. Credentials are personal, and whoever holds them answers for what is done with them.

Los datos que un negocio carga en la plataforma siguen siendo suyos. Nosotros los tratamos para prestarle el servicio, según la política de privacidad.

Data a business loads into the platform remains its own. We process it to provide the service, under the privacy policy.

6. Disponibilidad

6. Availability

Trabajamos para que el servicio esté disponible, pero depende también de terceros — operadores, proveedores de nube — y puede interrumpirse por mantenimiento o por causas fuera de nuestro control. Salvo que se pacte un nivel de servicio por escrito, el servicio se presta «tal cual».

We work to keep the service available, but it also depends on third parties — carriers, cloud providers — and may be interrupted by maintenance or by causes outside our control. Unless a service level is agreed in writing, the service is provided "as is".

7. Responsabilidad

En la medida que la ley lo permita, no respondemos por daños indirectos, lucro cesante ni pérdida de datos, y nuestra responsabilidad total se limita a lo pagado por el servicio en los doce meses anteriores al hecho.

To the extent permitted by law, we are not liable for indirect damages, lost profits or lost data, and our total liability is limited to the amounts paid for the service in the twelve months before the event.

8. Terminación

Cualquiera de las partes puede terminar el servicio según lo pactado. Al terminar, el negocio puede pedir una exportación de sus datos durante un plazo razonable.

Either party may terminate the service as agreed. On termination, the business may request an export of its data within a reasonable period.

9. Ley aplicable

9. Governing law

Estos términos se rigen por las leyes del Estado de Florida, Estados Unidos.

These terms are governed by the laws of the State of Florida, United States.
